Terms of use

IzzySpells is made by EAIA LLC. Using the app means accepting these terms. They are written to be read, so they are short.

1. What the app is

IzzySpells is a talking letterboard: a communication aid that speaks the letters, words and sentences someone spells on it. It runs on the device, uses the speech voices the operating system already provides, and needs no connection to work.

It is direct selection only. Whoever is using it presses the keys on the device themselves. There is no facilitator or assistant mode, and no way inside the app for a second person to enter, confirm or change a letter.

2. What the app is not

It is not a medical device, and nothing it does is diagnosis, treatment or clinical advice. It does not replace a speech and language therapist, a doctor, or anyone else's professional judgement about how a person communicates. We make no claim that using it improves, restores or develops anybody's communication.

It makes no claim about authorship. The app records the keys pressed on the device it is running on, and nothing else. It does not verify, attest to, or produce evidence of who composed a message. Saved phrases are a convenience for the person using the board, not a record of anything beyond the keystrokes the device received, and they should not be relied on as proof of authorship in any setting where that question matters.

It is also not an emergency service. Do not rely on it to call for help. Like any piece of software on any device it can fail, and a battery can go flat, so anyone who depends on it for communication should have another means available.

3. Buying the app

4. Payment and refunds

Purchases are made through Apple's App Store or Google Play, never directly with us. Those companies take the payment, hold the payment details, issue the receipt, and handle refunds under their own policies. We never see a card number.

Refund requests therefore go to the store, not to us: reportaproblem.apple.com for Apple, or Google Play's own order history for Android. If something has clearly gone wrong, write to us anyway. We will help you take it up, even though we cannot process it ourselves.

5. Fair use of the app

You get a personal, non-transferable licence to use IzzySpells on the devices your store account allows. Please do not resell it, rent it out, take it apart, or work around the purchase. The app, its name and its design stay ours.

What is spelled on the board is yours. It stays on the device, and we claim nothing over it.

6. Who the app is for, and who may buy it

The app is intended for people aged 13 and over. It is built for someone who cannot speak, and the person spelling on it is usually not the person who set it up.

You must be 18 or over to buy the app. A purchase is a contract, and the party to it is the adult who makes it. The person using the board is never asked for anything, and there is no account anywhere in this app for anybody to have.

Purchases are made by an adult: the app asks a question a child is not expected to answer before it opens the payment sheet, and the store account being charged belongs to the adult who set the device up. If a purchase was made on your store account without your knowledge, that store's refund process is the way to undo it.

7. Changes, and ending

These terms may change. The version here is always the current one, with the date at the top updated, and continuing to use the app after a change means accepting it. A price change affects new buyers only: what you paid is what you paid, and nothing about your copy changes afterwards.

The app may be updated or, one day, withdrawn from sale. Withdrawing it does not take it off a device that has bought it, and nothing you have saved is touched. It would stop new purchases and, in time, stop receiving updates.

8. No warranty, and what we are liable for

The app is provided as it is. We do not promise it will be free of faults or available without interruption. To the extent the law allows, our liability is limited to what you paid for the app.

Nothing here removes rights you have that cannot be removed. If you are a consumer, your local consumer law still applies in full, whatever this page says.

9. Apple and Google

This agreement is between you and EAIA LLC, not with Apple or Google. They are not responsible for the app or its contents. They have no obligation to provide support for it: support is admin@izzylifeapp.com. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

10. Governing law

IzzySpells is published by EAIA LLC, a limited liability company registered in Florida, United States, trading as IzzyLifeApp. These terms are governed by the laws of the State of Florida, and the courts there are where a dispute would be heard.

The app is sold in every country the App Store and Google Play operate in. If you bought it somewhere whose consumer-protection law gives you rights that cannot be signed away, that law still applies to you and the sentence above does not take it from you. Nothing in these terms limits a right your own country gives you.
